A Londoner living in a flat complained to his Council about noise from the rented flat upstairs. The Council had leased the flat from a private landlord who had installed laminate flooring throughout. The Council refused to investigate or take any action. The Local Government Ombudsman also refused to take any steps to make the Council investigate the noise in accordance with its statutory duty.
The Client and his wife had been reduced to sleeping on friends' floors and the the Client had even had to give up working full time due to the devastating affect of the noise.
In a series of Noisedirect Consultations, the Client was able to obtain advice on how to take direct action to make the the Landlord take responsibility for his property. Eventually the tenants vacated the property. The Client sued for damages and obtained a judgment in the County Court for £50,000. The Client was later able to apply for a Charging Order on the Landlord's property.
